Georgia Department of Education Settles With OCR

Office For Civil Rights (OCR) Disability Discrimination Determination - Georgia Department of Education (GA DOE).

On September 30, 2011, the GA DOE entered into a Resolution Agreement with the OCR after the federal agency responsible for enforcing Section 504 of the Rehabilitation Act of 1973 (Section 504) and Title II of the Americans with Disabilities Act of 1990 (Title II) conducted an investigation into Complaints that were filed against each of the public school districts in the state.

The Complaints alleged that the GA DOE and the Local Educational Agencies within the state (LEAs) have failed to develop and disseminate a system of procedural safeguards, including provisions regarding Section 504 impartial due process hearings with respect to the evaluation, eligibility and placement of students.
